petitioner, whose counsel “very rowdily exuberated” that paying costs was not an issue and he was even ready to pay Rs 1 lakh, ended up paying the same. “On the invitation of the counsel for the petitioner, the cost imposed is enhanced to Rs 1 lakh,” Justice Arun Monga asserted.
The order has its genesis in a petition filed against Haryana and other respondents, alleging inaction on the part of a Superintendent of Police regarding non-registration of FIR despite the petitioner’s complaint.
Justice Monga asserted that it was observed in an inquiry report that the entire matter was already sub judice in a civil court as the petitioner had already filed two civil suits against the respondents and the petitioner had not challenged the report before any judicial forum.
